第1条　適用範囲

Article 1 Scope of application

  1. 当館が宿泊客との間で締結する宿泊契約及びこれに関連する契約は、この約款の定めるところによるものとし、この約款に定めのない事項については、法令又は一般に確立された慣習によるものとします。 Accommodation contracts and related contracts concluded by the hotel with guests shall be governed by the provisions of this agreement, and matters not stipulated in this agreement shall be governed by laws and regulations or generally established customs.
  2. 当館が、法令及び慣習に反しない範囲で特約に応じたときは、前項の規定にかかわらず、その特約が優先するものとします。 If the museum accepts a special contract to the extent that it does not violate laws and customs, the special contract shall take precedence regardless of the provisions of the preceding paragraph.

第2条　宿泊契約の申込み

Article 2 Application for accommodation contract

  1. 当館に宿泊契約の申込みをしようとする者は、次の事項を当館に申し出ていただきます。 Those who wish to apply for an accommodation contract with the hotel are requested to inform the hotel of the following matters.
    1. 宿泊者名 Guest name
    2. 宿泊日及び到着予定時刻 Accommodation date and estimated time of arrival
    3. 泊料金(原則として別表第１の基本宿泊料による。) Accommodation charges (in principle, based on the basic accommodation charges in Attached Table 1)
    4. その他当館が必要と認める事項 Other matters deemed necessary by the museum
  2. 宿泊客が、宿泊中に前項第2号の宿泊日を超えて宿泊の継続を申し入れた場合、当館は、その申し出がなされた時点で新たな宿泊契約の申し込みがあったものとして処理します。 If the guest requests to continue staying beyond the staying date specified in item 2 of the preceding paragraph during the stay, the hotel will treat it as if a new accommodation contract had been applied at the time of the request.

第3条　宿泊契約の成立等

Article 3 Establishment of accommodation contract, etc.

  1. 宿泊契約は、当館が前条の申し込みを承諾したときに成立するものとします。ただし、当館が承諾をしなかったことを証明したときは、この限りではありません。 The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article. However, this does not apply when the museum proves that it has not consented.
  2. 前項の規定により宿泊契約が成立したときは、宿泊期間(3日を超えるときは3日間)の基本宿泊料を限度として当館が定める申込金を、当館が指定する日までに、お支払いいただきます。 When the accommodation contract is concluded pursuant to the provisions of the preceding paragraph, the application fee set by the hotel shall be paid by the date designated by the hotel, up to the basic accommodation fee for the accommodation period (3 days if it exceeds 3 days).
  3. 申込金は、まず、宿泊客が最終的に支払うべき宿泊料金に充当し、第6条及び第18条の規定を適用する事態が生じたときは、違約金に次いで賠償金の順序で充当し、残額があれば、第12条の規定による料金の支払いの際に返還します。 The application fee will first be applied to the accommodation fee to be finally paid by the guest, and if the provisions of Articles 6 and 18 apply, the application fee will be applied in the order of penalty and then compensation.   4. 第2項の申込金を同項の規定により当館が指定した日までにお支払いいただけない場合は、宿泊契約はその効力を失うものとします。ただし、申込金の支払期日を指定するに当たり、当館がその旨を宿泊客に告知した場合に限ります。 If the application fee set forth in paragraph 2 is not paid by the date designated by the hotel pursuant to the provisions of the same paragraph, the accommodation contract shall cease to be effective. 第4条　申込金の支払いを要しないこととする特約

  1. 前条第2項の規定にかかわらず、当館は、契約の成立後同項の申込金の支払いを要しないこととする特約に応じることがあります。 Notwithstanding the provisions of Paragraph 2 of the preceding Article, the NDL may accept a special contract that does not require payment of the application fee set forth in the same paragraph after the contract is concluded.
  2. 宿泊契約の申し込みを承諾するに当たり、当館が前条第2項の申込金の支払いを求めなかった場合及び当該申込金の支払期日を指定しなかった場合は、前項の特約に応じたものとして取り扱います。 If the hotel does not request payment of the application fee set forth in paragraph 2 of the preceding article or does not specify the due date for payment of the application fee when accepting the application for the accommodation contract, it will be treated as complying with the special provision set forth in the preceding paragraph.

第5条　宿泊契約締結の拒否

Article 5 Refusal to conclude an accommodation contract

  1. 当館は、次に掲げる場合において、宿泊契約の締結に応じないことがあります。 The hotel may not accept the conclusion of an accommodation contract in the following cases.
    1. 宿泊の申し込みが、この約款によらないとき。 When the application for accommodation does not comply with this agreement.
    2. 満室(員)により客室の余裕がないとき。 When there is no room in the guest room due to full occupancy (members).
    3. 宿泊しようとする者が、宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をするおそれがあると認められるとき。 When it is recognized that the person who intends to stay may act in violation of the provisions of laws and regulations, public order, or good manners and customs regarding accommodation.
    4. 宿泊しようとする者が、次のイからハに該当すると認められるとき。 When the person who intends to stay is deemed to fall under any of the following (イ) to (ハ).
      1. 暴力団員による不当な行為の防止等に関する法律(平成3年法律第77号)第2条第2号に規定する暴力団(以下「暴力団」という。)、同条第2条第6号に規定する暴力団員(以下「暴力団員」という。)、暴力団準構成員又は暴力団関係者その他の反社会的勢力 The gangsters stipulated in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Boryokudan Members (Act No. 77 of 1991) (hereinafter referred to as "gangsters"), stipulated in Article 2, Item 6 of the same Article.     6. 宿泊しようとする者が、伝染病者であると明らかに認められるとき。 When the person who intends to stay is clearly recognized as having an infectious disease.
    7. 宿泊に関し暴力的要求行為が行われ、又は合理的な範囲を超える負担を求められたとき。 When a violent request for accommodation is made or a burden exceeding a reasonable range is requested.
    8. 天災、施設の故障、その他やむを得ない事由により宿泊させることができないとき。 When it is not possible to stay overnight due to a natural disaster, facility failure, or other unavoidable reason.
    9. 宮城県旅館業法施行条例5条の規定する場合に該当するとき。 When the case falls under the provisions of Article 5 of the Miyagi Prefecture Ryokan Business Law Enforcement Ordinance.

第6条　宿泊客の契約解除権

  1. 宿泊客は、当館に申し出て、宿泊契約を解除することができます。 The guest can cancel the accommodation contract by notifying the hotel.
  2. 当館は、宿泊客がその責めに帰すべき事由により宿泊契約の全部又は一部を解除した場合(第3条第2項の規定により当館が申込金の支払期日を指定してその支払いを求めた場合であって、その支払いより前に宿泊客が宿泊契約を解除したときを除きます。)は、別表第2に掲げるところにより、違約金を申し受けます。ただし、当館が第4条第1項の特約に応じた場合にあっては、その特約に応じるに当たって、宿泊客が宿泊契約を解除したときの違約金支払義務について、当館が宿泊客に告知したときに限ります。 If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest (in accordance with the provisions of Article 3, Paragraph 2, the hotel requests payment by designating the due date of the application fee. 第7条　当館の契約解除権

  1. 当館は、次に掲げる場合においては、宿泊契約を解除することがあります。 The hotel may cancel the accommodation contract in the following cases.
    1. 宿泊客が宿泊に関し、法令の規定、公の秩序若しくは善良の風俗に反する行為をするおそれがあると認められるとき、又は同行為をしたと認められるとき。 When it is recognized that the guest may act in violation of the provisions of laws and regulations, public order, or good manners and customs, or when it is recognized that the guest has committed the same act.
    2. 宿泊客が次のイからハに該当すると認められるとき。 When the guest is deemed to fall under any of the following (イ) to (ハ).
      1. 暴力団、暴力団員、暴力団準構成員又は暴力団関係者その他の反社会的勢力 Boryokudan, Boryokudan members, Boryokudan associate members or Boryokudan officials and other antisocial forces
      2. 暴力団又は暴力団員が事業活動を支配する法人その他の団体であるとき When a gangster or a gangster is a corporation or other organization that controls business activities
      3. 法人でその役員のうちに暴力団員に該当する者があるもの A corporation whose officers are classified as gangsters

    6. 天災等不可抗力に起因する事由により宿泊させることができないとき。 When it is not possible to stay overnight due to reasons such as natural disasters caused by force majeure.
    7. 宮城県旅館業法施行条例5条の規定する場合に該当するとき。 When the case falls under the provisions of Article 5 of the Miyagi Prefecture Ryokan Business Law Enforcement Ordinance.
    8. 寝室での寝たばこ、消防用設備等に対するいたずら、その他当館が定める利用規則の禁止事項(火災予防上必要なものに限る。)に従わないとき。 When you do not comply with the prohibited items (limited to those necessary for fire prevention) of the usage rules established by the hotel, such as sleeping cigarettes in the bedroom, mischief against firefighting equipment, etc.
  2. 当館が前項の規定に基づいて宿泊契約を解除したときは、宿泊客がいまだ提供を受けていない宿泊サービス等の料金はいただきません。 If the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for accommodation services that have not yet been provided.

第8条　宿泊の登録

Article 8 Accommodation registration

  1. 宿泊客は、宿泊日当日、当館のフロントにおいて、次の事項を登録していただきます。 Guests are required to register the following items at the front desk of the hotel on the day of their stay.
    1. 宿泊客の氏名、年令、性別、住所及び職業 Guest's name, age, gender, address and occupation
    2. 外国人にあっては、国籍、旅券番号、入国地及び入国年月日 For foreigners, nationality, passport number, place of entry and date of entry
    3. 出発日及び出発予定時刻 Departure date and scheduled departure time
    4. その他当館が必要と認める事項 Other matters deemed necessary by the museum
  2. 宿泊客が第12条の料金の支払いを、旅行小切手、宿泊券、クレジットカード等通貨に代わり得る方法により行おうとするときは、あらかじめ、前項の登録時にそれらを呈示していただきます。 If the guest intends to pay the charges under Article 12 by a method that can be used in place of currency such as travel checks, accommodation vouchers, credit cards, etc., they must be presented in advance at the time of registration set forth in the preceding paragraph.

第9条　客室の使用時間

Article 9 Room usage time

  1. 宿泊客が当館の客室を使用できる時間は、午後3時から翌朝10時までとします。ただし、連続して宿泊する場合においては、到着日及び出発日を除き、終日使用することができます。 Guests can use our guest rooms from 3:00 pm to 10:00 the next morning. However, if you stay consecutively, you can use it all day except the arrival date and departure date.
  2. 当館は、前項の規定にかかわらず、同項に定める時間外の客室の使用に応じることがあります。この場合には次に掲げる追加料金を申し受けます。 Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of guest rooms outside the hours specified in the same paragraph. In this case, the following additional charges will be charged.
    1. 超過3時間までは、室料金の3分の1(又は室料相当額の33%) Up to 3 hours over, 1/3 of room charge (or 33% of room charge equivalent)
    2. 超過6時間までは、室料金の2分の1(又は室料相当額の50%) Up to 6 hours over, half of the room charge (or 50% of the room charge equivalent)
    3. 超過6時間以上は、室料金の全額 (又は室料相当額の100%) Full room charge (or 100% of room charge equivalent) for over 6 hours
  3. 前項の室料相当額は、基本宿泊料の70%とします The amount equivalent to the room charge in the preceding paragraph shall be 70% of the basic accommodation charge.

第10条　利用規則の遵守

  1. 宿泊客は、当館内においては、当館が定めて館内に掲示した利用規則に従っていただきます。 Guests are required to follow the usage rules established by the hotel and posted in the hotel.

第11条　営業時間の遵守

  1. 当館の主な施設等の営業時間は次のとおりとし、その他の施設等の詳しい営業時間は備付けパンフレット、各所の掲示、客室内のサービスディレクトリー等で御案内いたします。 The business hours of the main facilities of the hotel are as follows, and detailed business hours of other facilities will be announced in the pamphlets provided, notices in various places, service directories in the guest rooms, etc.

  2. 前項の時間は、必要やむを得ない場合には臨時に変更することがあリます。その場合には、適当な方法をもってお知らせします。 The time in the preceding paragraph may be changed temporarily if necessary. In that case, we will inform you by an appropriate method.

第12条　料金の支払

  1. 宿泊者が支払うべき宿泊料金等の内訳は、別表第１に掲げるところによります。 The breakdown of the accommodation charges, etc. payable by the guest is as listed in Attached Table 1.
  2. 前項の宿泊料金等の支払いは、通貨又は当館が認めた旅行小切手、宿泊券、クレジットカード等これに代わり得る方法により、宿泊客の出発の際又は当館が請求した時、フロントにおいて行っていただきます。 Payment of the accommodation charges, etc. in the preceding paragraph shall be made at the front desk at the time of departure of the guest or when requested by the hotel, by currency or a travel check, accommodation voucher, credit card, etc. approved by the hotel.

第13条　当館の責任

Article 13 Responsibility of the hotel

  1. 当館は、宿泊契約及びこれに関連する契約の履行に当たり、又はそれらの不履行により宿泊客に損害を与えたときは、その損害を賠償します。ただし、それが当館の責めに帰すべき事由によるものでないときは、この限りではありません。 The hotel will compensate the guest for any damages caused to the guest in the performance of the accommodation contract and related contracts, or due to the non-performance thereof. However, this does not apply if it is not due to reasons attributable to the museum.
  2. 当館は、万一の火災等に対処するため、旅館賠償責任保険に加入しております。 The hotel has inn liability insurance to deal with fires.

第14条　契約した客室の提供ができないときの取扱い

  1. 当館は、宿泊客に契約した客室を提供できないときは、宿泊客の了解を得て、できる限り同一の条件による他の宿泊施設をあっ旋するものとします。 If the hotel cannot provide the contracted guest room to the guest, the hotel shall arrange other accommodation facilities under the same conditions as much as possible with the consent of the guest.
  2. 当館は、前項の規定にかかわらず他の宿泊施設のあっ旋ができないときは、違約金相当額の補償料を宿泊客に支払い、その補償料は損害賠償額に充当します。ただし、客室が提供できないことについて、当館の責めに帰すべき事由がないときは、補償料を支払いません。 Notwithstanding the provisions of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty if other accommodation facilities cannot be arranged, and the compensation fee will be applied to the amount of compensation for damages. 第15条　寄託物等の取扱い

  1. 宿泊客がフロントにお預けになった物品又は現金並びに貴重品について、滅失、毀損等の損害が生じたときは、それが、不可抗力である場合を除き、当館は、その損害を賠償します。ただし、現金及び貴重品については、当館がその種類及び価額の明告を求めた場合であって、宿泊客がそれを行わなかったときは、当館は15万円を限度としてその損害を賠償します。 In the event of loss, damage, or other damage to the goods, cash, or valuables deposited by the guest at the front desk, the hotel will compensate for the damage unless it is force majeure.   2. 宿泊客が、当館内にお持込みになった物品又は現金並びに貴重品であってフロントにお預けにならなかったものについて、当館の故意又は過失により滅失、毀損等の損害が生じたときは、当館は、その損害を賠償します。ただし、宿泊客からあらかじめ種類及び価額の明告のなかったものについては、当館に故意又は重大な過失がある場合を除き、 15万円を限度として当館はその損害を賠償します。 If the guest brings in goods, cash, or valuables that were not left at the front desk and is lost or damaged due to intentional or negligence of the hotel, the hotel will be damaged. 第16条　宿泊客の手荷物又は携帯品の保管

  1. 宿泊客の手荷物が、宿泊に先立って当館に到着した場合は、その到着前に当館が了解したときに限って責任をもって保管し、宿泊客がフロントにおいてチェックインする際お渡しします。 If the guest's baggage arrives at the hotel prior to the stay, it will be responsibly stored only if the hotel agrees before the arrival and will be handed to the guest at the front desk when checking in.
  2. 宿泊客がチェックアウトしたのち、宿泊客の手荷物又は携帯品が当館に置き忘れられていた場合において、その所有者が判明したときは、当館は、当該所有者に連絡をするとともにその指示を求めるものとします。ただし、所有者の指示がない揚合又は所有者が判明しないときは、発見日を含め7日間保管し、その後最寄りの警察署に届けます。 If the guest's baggage or personal belongings are left behind in the hotel after the guest checks out and the owner is identified, the hotel will contact the owner and request instructions. will do. 第17条　駐車の責任

  1. 宿泊客が当館の駐車場をご利用になる場合、車両のキーの寄託の如何にかかわらず、当館は場所をお貸しするものであって、車両の管理責任まで負うものではありません。ただし、駐車場の管理に当たり、当館の故意又は過失によって損害を与えたときは、その賠償の責めに任じます。 If the guest uses the parking lot of the hotel, regardless of the deposit of the vehicle key, the hotel will rent the place and will not be responsible for the management of the vehicle. 第18条　宿泊客の責任

  1. 宿泊客の故意又は過失により当館が損害を被ったときは、当該宿泊客は当館に対し、その損害を賠償していただきます。 If the hotel suffers damage due to the intention or negligence of the guest, the guest will be required to compensate the hotel for the damage.
